By accessing or using VibeCore, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service. These Terms constitute a legally binding agreement between you and VibeCore.

2. Description of Service

VibeCore provides AI-powered content generation and text analysis APIs (the "Service"). The Service includes various tools and features that allow users to generate content, analyze text, and integrate AI capabilities into their applications.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any breach of security or unauthorized use of your account
• Take responsibility for all activities that occur under your account

4. Subscription and Payments

4.1 Billing: Some features of the Service require payment of fees. You agree to pay all applicable fees in connection with your use of the Service. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.2 Subscription Terms: Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us.

5. Acceptable Use Policy

You agree not to use the Service to:

• Generate or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate or distribute malware, viruses, or any other harmful code
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to generate content for deceptive or fraudulent purposes
• Create multiple accounts to circumvent usage limits or bans
• Resell, sublicense, or redistribute the Service without authorization
• Use the Service to generate content that promotes discrimination, violence, or illegal activities

6. API Usage and Rate Limits

6.1 Rate Limits: Your use of the API is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary suspension of API access.

6.2 API Keys: You are responsible for maintaining the confidentiality of your API keys. Do not share your API keys publicly or include them in client-side code.

6.3 Quotas: Usage is tracked monthly. Unused quotas do not roll over to the next month unless explicitly stated in your subscription plan.

7. Intellectual Property

7.1 Our Rights: The Service and its original content, features, and functionality are owned by VibeCore and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content: You retain all rights to the content you input into the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

7.3 Generated Content: You own the rights to content generated through the Service, subject to your compliance with these Terms.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. THE OUTPUT GENERATED BY AI MODELS MAY NOT ALWAYS BE ACCURATE, APPROPRIATE, OR RELIABLE. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING AND USING THE GENERATED CONTENT.

10. Limitation of Liability

IN NO EVENT SHALL VIBECORE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless VibeCore and its licensors and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which VibeCore operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
